Act 227
Act 227 will bring a level of transparency and clarity to long-term ground lease arbitrations never before seen in the state. This transparency is good for lessees, lessors, and will add value to the long-term ground lease arbitration process.
Act 227 became law as of July 12, 2011, and all applies to all long-term ground lease rent arbitrations across the State of Hawaii. If you have a long-term ground lease and the rent is due to be reset, Act 227 may be applicable and of great interest to you and your management team.
